Terms & Conditions (EU • United Kingdom • Switzerland)

1. Scope

These Terms & Conditions apply to all orders placed through our online shop by customers from the European Union, the United Kingdom and Switzerland.

2. Contractual Partner / Conclusion of Contract

The purchase contract is concluded with:

Curry Premium Wines oHG
Landsberger Str. 63b
86938 Schondorf
Germany

The presentation of products in the online shop does not constitute a legally binding offer but a non-binding online catalogue. You may first place products in your shopping basket without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided during the ordering process.

By clicking the order button, you submit a binding order for the goods contained in your shopping basket. Receipt of your order will be confirmed by email immediately after the order has been submitted.

The point at which a contract is concluded with us depends on the payment method chosen:

Invoice (available from the second order onwards)

We will accept your order either by sending a separate order confirmation email or by dispatching the goods within two days. The invoice amount is payable after receipt of the goods and invoice by bank transfer. We reserve the right to offer payment by invoice only to existing customers.

Advance Payment (Bank Transfer)

We accept your order by sending an order confirmation email within two days, which will also include our bank details. If no payment is received within five working days, the order will be cancelled automatically.

Stripe – Credit Card (AMEX, MasterCard, Visa)

Payment processing is carried out via Stripe, 8th St STE 100, San Francisco, CA 94110-2043, USA. For this purpose, information relating to your order (name, address, account number, bank code, credit card number if applicable, invoice amount, currency and transaction number) is transmitted to Stripe exclusively for the purpose of payment processing. More information: https://stripe.com/de/terms
Credit card data is not stored on our website.

PayPal, PayPal Express, SEPA Direct Debit

During the order process you will be redirected to PayPal. After authorising the payment at PayPal and submitting your order in the shop, we instruct PayPal to initiate the payment transaction. This constitutes acceptance of your offer.

3. Contract Language / Storage of Contract Text

The language available for concluding the contract is German. We store the contract text and send you the order details and our Terms & Conditions by email. For security reasons, the contract text is no longer accessible via the internet after completion.

4. Delivery Conditions

In addition to the stated product prices, shipping costs will be charged.

Details regarding shipping costs are provided within the product offers or shipping information pages.

Delivery is made exclusively by shipping; collection of goods is not possible.

Customs duties, import taxes or handling fees may apply in non-EU countries (including the UK and Switzerland) and shall be borne by the customer where applicable.

5. Payment Methods

The following payment methods are available:

• Advance Payment (Bank Transfer)
• Stripe / Credit Card (AMEX, MasterCard, Visa)
• PayPal / PayPal Express / SEPA Direct Debit
• Invoice (for existing customers only and from the second order onward)

Delivery takes place after successful payment authorisation unless otherwise specified.

6. Retention of Title

The goods remain our property until full payment has been made.

7. Warranty & Statutory Rights

Statutory warranty rights apply.

Any voluntary guarantees that may exist and their conditions will be indicated with the respective product or in separate product information.

This does not affect your mandatory consumer rights:

• EU consumers: according to applicable EU consumer protection legislation
• UK consumers: according to the UK Consumer Rights Act and applicable distance selling regulations
• Swiss consumers: according to applicable Swiss consumer protection law

Mandatory consumer rights remain unaffected in all jurisdictions.

8. Online Dispute Resolution

EU consumers: The European Commission provides a platform for online dispute resolution (ODR), available at:
https://ec.europa.eu/consumers/odr/

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

9. Age Restriction (Protection of Minors)

If your order includes goods subject to age restrictions, a reliable identity and age verification process is used to ensure that the purchaser meets the legally required minimum age. Delivery will only be made after successful age verification and only to the purchaser personally.

10. Applicable Law & Jurisdiction

The contractual relationship is governed by German law.

For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory consumer protection regulations of the country in which they have their habitual residence (EU / UK / Switzerland).
